What kind of divorce lawyer do you need?

If you have to employ the services of a divorce lawyer then you need to be confident you have chosen correctly; ensure that your lawyer has at least the following attributes and abilities:


  • Fully qualified to deal with your case

  • Have the right frame of mind for this type of work

  • Reputable


The best attorney to employ is one who, for at least half their time, is dealing with divorce cases and is fully skilled in mediation techniques. However, none of this will be any good without your complete trust in their abilities. Mediation minded attorneys are more likely to give you problem solving advice, whereas traditional attorneys tend to be more oriented to conflict and their advice tends to be adversarial. A divorce lawyer is a busy person so before you contact them know exactly what information you need them to supply.

This is best done by knowing exactly what you intend to speak to them about and write down questions and answers in addition to when, and the length of the conversation on each occasion. As all costs relating to law and legal advice are costly, try not to visit them at the office unless absolutely necessary; this can be achieved by using the phone or mail. Your divorce attorney is just a resource for legal matters so do not try to get them personally involved as that is not their function; if you need emotional support there are others who can help with this. Never trouble your divorce lawyer with trivial matters that do not directly concern the divorce.

The most important aspect for you to get sorted out is the control of the situation which should be yours and then you will be able to use your lawyer more effectively. Tell them you want good advice and will rely on their experience, but that you expect to make decisions that concern the tone and strategy of the case. Let them know that copies of any correspondence relating to the case will need to be sent to you along with any other information and if you contact them, to reply as quickly as possible.

Don’t think that you have to enter into proceedings armed with a lawyer in tow as they aren’t always necessary although you may wish to speak to one just for advice on a marital settlement for example. This means that a little research is necessary on your part but once you have completed this, it is much easier to contact a lawyer to ask them specific questions and how they see your case concluding. Marital settlements are something that can be arranged by the individuals involved and then have them checked by a divorce lawyer; then if things don’t work out, the lawyer can always be hired to make the divorce settlement.
